Conditions of Use

Preface
The following terms of trade only apply to trade with merchants, juristic people of public law or public-juristic separate assets.
These terms of trade advert to all agreements, consignments and other work performed.

Conclusion of the contract
By pressing the button “order” you are placing a binding order of all items in your basket of goods. A conclusion of contract of sale needs our affirmation in form of an advice of dispatch or the delivery of the ordered goods.

Delivery of Samples
We are pleased to send single samples against payment. Please contact us for further information.

Partial delivery
To guarantee quick processing of your orders, we are allowed to send partial deliveries if there is no other arrangement.

Quantity of delivery
At items with commercial printing we reserve the right of 10 % more or less delivery.

Consignment
We have fixed cost of delivery for Germany and Austria.
Germany: up to € 450,00 = delivery cost of € 3,90
Austria:    up to € 450,00 = delivery cost of € 6,50
From this arrangement excepted are custom products, wooden boxes and displays and collections in bigger quantity (more than 3 units) as well as deliveries that are because of customer preferences delivered by a special type of dispatch, cash on delivery or express delivery.
Deliveries to all other countries are charged with actual costs.
Terms of direct shipment are available on request. Please contact us. We are pleased to help you.
Passing of risk according to German law (§447 BGB) in all cases.
For correct delivery on schedule date of dispatch is decisive factor.
We don’t accept liability consequences arising out of loss or delay during transport.

Free delivery
Orders within Germany and Austria with order value bigger than € 450,00 are free of transportation charges.
From this arrangement excepted are custom products, wooden boxes and displays and collections in bigger quantity (more than 3 units) as well as deliveries that are because of customer preferences delivered by a special type of dispatch, cash on delivery or express delivery.

Packaging
No costs of packaging are billed with us. If possible we reuse packaging material.

Cargo insurance: 1% of merchandise value

Price setting
All mentioned prices are subject to change and are exclusive of value added tax.
All of our offers about prices, quantities, delivery time as well as about possibilities of dispatch are always subject to change and without guarantee.

Payment
Within Germany we provide following possibilities of payment:
Sofortüberweisung, 4% less discount
Paypal, 4% less discount
Cash in advice, 4% less discount
Direct debit, 4% less discount
Charge forward, 3% less discount

Established Customers are additionally allowed to pay via account.
For payment within 10 days, 2% less discount, within 30 days, net price applies.

Reservation of proprietary rights
The delivered goods remain our property until they have been fully paid.
By converting of goods customers don’t get property rights of the fully or in parts produced goods. If Reservation of proprietary rights should turn inoperative because of any reasons distributor and customer by now agree that the property rights are given to Bartl GmbH including the converting process. The goods remain by the customer free of charge.
When converting combined with third party propertied goods Bartl GmbH gains co-ownership with the new goods.
The amount of co-ownership is due to proportion of the invoice value of the delivered goods and the invoice value of the remaining goods.
Hereby the customer transfers claims out of resale to the distributor, also in cases of converted goods. If the converted goods except of buyers´ conditional goods only contain goods delivered with simple Reservation of proprietary rights the customer transfers fully price demand to Bartl GmbH.
In case of precession of goods by several distributors, each distributor is entitled to a fraction of demand according to the ratio of the invoice value of his conditional goods and the invoice value of the other used goods.
If the distributors´ total receivables are covered by more than 120% by such cessions doubtlessly, the surplus of receivables gets cleared on customers request after selection by Bartl GmbH.
If goods that depend on our reservation of proprietary rights get blocked or impounded by a third party the borrower is bound to inform Bartl GmbH immediately.

Data handling
Bartl GmbH collects and saves your address data for electronic order-services and accountancy. Bartl GmbH also uses your data for commercial reasons to provide you with news and information.
If you don’t want us to use your data for news and information please contact our office or send us this demand in writing.

Claim & warranty
All clear and/or recognized scarcities, missing parts or wrong deliveries need to be blamed in writing within seven days and in all cases before converting or selling.
If complaints are legitimate seller decides about repairing, compensation delivery or aging of value for defect or missing goods.
Consequential harms caused by a defect are excluded.

Liability
Claim for damages arising from delay, non-performance because of impossibility, breach of contractual or lawful duties, blame while conclusion of contract or non-contractual liability are barred on principle.

Place of jurisdiction
In all cases laws of the Federal Republic of Germany shall apply. Place of all jurisdiction for all claims arising from your order is Altötting.

Acceptance
By placing an order the conditions of these terms of trade apply as accepted.
They also apply to reorders and all kind of following contracts when the consumer placed or accepted an order according to his terms of trade.
All kinds of additional agreements differing from these terms of trade need the form of writing.
